Article 1 Definitions
In these Terms of Agreement the following terms in the following definition will be used, unless explicitly otherwise indicated or is obvious in a certain context:
a. Brokenpaper: the user of these Terms of Agreement, the shopowner
b. Customer: Every customer of Brokenpaper
c. Agreement: the agreement between the customer and Brokenpaper;
d. Website: the website www.brokenpaper.nl
Article 2 General
2.1 Possible deviations on these Terms of Agreement are only valid if these have been explicitly agreed upon in writing or electronically
2.2 If one or more provisions in these Terms of Agreement are voided or may be destroyed, the remaining Terms of Agreement are still valid. Brokenpaper and the customer will then, in mutual agreement, decide upon new provisions as a replacement of the voided or destroyed provisions, with which the goal and scope of the original provisions will be kept to as much as possible.
Article 3 Special offers and tenders
3.1 The assortment that we offer on the website can be altered. Alterations in the assortment will only take place before the creation of the agreement.
3.2 On the website, in catalogs and mails we try to have the image be as close as possible to reality. Obvious typing mistakes are with reservation.
3.3 The stated prices for the offered products in euro's are including VAT and excluding shipping costs.
3.4 Special offers do not automatically count for future orders.
3.5 Brokenpaper will explicitly indicate when a special offers has a limited time of validity or is under certain terms.
Article 4 Formation of the agreement
4.1 The agreement is formed the moment the customer accepts the offer and the fulfillment of the corresponding conditions.
4.2 If the customer has accepted the offer by electronic means, Brokenpaper immediately confirms the reception of the acceptance of the offer through electronic means. As long as the reception of this acceptance is not confirmed, the customer can annul the agreement.
Article 5 Price Change
5.1 If the prices for the offered products rise after the formation of the agreement, the customer has the right to annul the agreement the day the price change is of effect.
5.2 Price increase after formation of the agreement is allowed if the price increase is the result of a increase in the VAT or another judicial measure.
Article 6 Delivery and Delivery time
6.1 The ordered products are usually shipped within 24 hours after we have received full payment.
Article 7 Payment
7.1 For your convenience we provide several payment options.
Article 8 returns and refunds
8.1 The customer has the right to, during a period of 14 working days, annul the agreement without statement of reasons after receiving the product and return the delivered product, as long as it is unused and provided with the original labels, packaging, etc. In such a annulment Brokenpaper will refund the money within 30 days after receiving the product. The amount paid back can differ from the amount paid due to exchange rates and shipping costs.
8.2 If the customer annuls the agreement as stated in the agreement in paragraph of article 8, the shipping costs related to the returning of the product are to be paid for by the customer.
Article 9 Complaint arrangement
9.1 Brokenpaper advises you to inspect the delivered products immediately after receiving them and report any problems that turned up within a reasonable period of time.
9.2 Complaints can be reported at info@brokenpaper.nl
9.3 Complaints will be processed by Brokenpaper within 14 days. If the processing of a complaint is unexpectedly not possible within a period of 14 days, the customer will be notified of the delay.
Article 10 Property restrictions
10.1 All delivered and products that still have to be delivered exclusively remain the property of Brokenpaper, until all outstanding debts that the customer has for Brokenpaper are completely paid for.
10.2 As long as the property of the products has not passed on to the customer, the customer is not allowed to pawn the product or to confer any other rights to third parties.
Article 11 Privacy
11.1 Both parties are obligated to secrecy of all confidential information that they obtained as part of their agreement from each other or from another source. Information counts as confidential if this has been said so by the other party or if this was logical regarding the nature of the information. The party that obtains private information will only use this for the goal for which the information was originally given.
Article 12 Intellectual property
12.1 The customer must completely and unconditionally respect the intellectual property which rest on the by Brokenpaper delivered products.
12.2 Without antecedent permission by Brokenpaper in the form of writing or electronically, the customer may not copy, send on, distribute, reproduce or publish information, texts, logo's, brands, trade names and images which he or she received via the website.
Article 13 Customer Service
13.1 For questions about orders and such the customer can contact the Customer Service of Brokenpaper via mail or by phone.
Artikel 14 Personal Details
14.1 Brokenpaper ensures that the collection of personal details obtained from the customer meet the law protection of personal details.
14.2 Brokenpaper processes personal details (such as: name, address, e-mail and telephone number) for the following purposes:
a. the delivery of ordered products;
b. the managing of a customer database
14.3 Brokenpaper will never provide personal details to thirds, unless this was distinctly allowed by the customer.
Article 15 Security and internet
15.1 Brokenpaper takes appropriate technical and organizational measures to protect the electronic transferal of data in the case that the customer has accepted the offer through the electronic route. Brokenpaper will take appropriate security measures so that the customer can pay electronically. In that context Brokenpaper will provide a safe internet environment.
Artikel 16 Final regulations
16.1 Applicable is always the version of the Terms of Agreement that was valid at the time of the agreement, unless the customer has accepted the validity of a revised version of the Terms of Agreement after the agreement has taken place.
16.2 Both parties will try their best to solve a dispute by mutual agreement.
16.3 On every agreement between Brokenpaper and the customer, Dutch law is of application. |
